By downloading, installing, or using Klopat ("the app", "we", "us", or "our"), you ("user" or "you") agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not download or use the app.
Throughout these Terms and within the app, the word "klopat" refers to a daily task, idea, or challenge presented to you by the app.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the app on any Apple-branded device that you own or control, solely for your personal, non-commercial purposes, as permitted by the App Store Terms of Service.

These Terms are concluded between you and the developer of Klopat only, and not with Apple, Inc. ("Apple"). Apple is not a party to these Terms and is not responsible for the app or its content. Apple has no obligation whatsoever to provide any maintenance or support services for the app.
Notwithstanding the foregoing, you acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
In the event of any conflict between these Terms and the App Store Terms of Service, the App Store Terms of Service shall prevail.
Klopat is an app that gives you one klopat per day. The app:
Klopat allows you to attach photos and text notes to your daily klopats. This content is created by you and stored exclusively on your device. We do not have access to, moderate, or transmit your content. You are solely responsible for any content you create within the app. Deleting the app permanently removes all user-created content.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the app, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from or relating to these Terms or the app shall not exceed the amount you paid for the app (if any).

Klopat does not provide professional advice of any kind, including but not limited to medical, health, financial, investment, legal, or psychological advice. Klopat suggestions are for general informational and motivational purposes only. Always consult qualified professionals before undertaking klopats that may affect your health, finances, legal standing, or wellbeing.
By using Klopat, you acknowledge and agree that:
The app, including all content, features, and functionality (including but not limited to design, graphics, text, and software), is owned by us and is protected by applicable copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the app beyond the limited license described herein.
We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of the app, including but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the app or your possession and use of the app infringes such third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
You may stop using Klopat at any time by deleting the app from your device. We reserve the right to terminate or suspend your access to the app at any time, without notice, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your license to use the app ceases immediately.
We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date. Your continued use of the app after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the app.
These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising from or relating to these Terms or the app that cannot be resolved informally shall be subject to binding arbitration or the exclusive jurisdiction of competent courts, as permitted by applicable law in your jurisdiction. Nothing in this section limits your rights under mandatory consumer protection laws in your country of residence.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the app, superseding any prior agreements.
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
By downloading or using Klopat, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
